The Services are provided by Chamoy Labs, LLC (“we,” “us,” or “our”), which operates the Chamoy service. By accessing or using the Services, you agree to be bound by these Terms.

Use of Services

You may use the Services only in compliance with these Terms and all applicable laws and regulations. You must be at least 18 years old to use the Services. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree not to misuse the Services, including but not limited to: interfering with or disrupting the Services, attempting to gain unauthorized access, or using the Services for any unlawful purpose, including to transmit spam, impersonate others, or upload harmful content.

Content and Intellectual Property

You retain ownership of any content you upload to the Services, including images, business details, and loyalty program information. By uploading content, you grant Chamoy Labs, LLC a limited, non-exclusive license to use, process, and display that content solely for the purpose of providing the Services to you.

You acknowledge that loyalty program pages and feedback forms created using the Services are intended to be publicly accessible via QR codes and shareable links. You are responsible for ensuring that your content is appropriate for public display.

The Services, including all software, design, text, and graphics, are owned by Chamoy Labs, LLC and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Services without our prior written consent.

Subscriptions and Payments

Certain features of the Services require a paid subscription. By subscribing, you agree to pay the applicable fees as described at the time of purchase. Subscriptions automatically renew unless cancelled before the end of the current billing period. You may cancel your subscription at any time through your account settings.

We reserve the right to change our pricing at any time. Any price changes will take effect at the start of your next billing cycle, and we will provide reasonable notice before any changes take effect.

Limitation of Liability

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. To the maximum extent permitted by law, Chamoy Labs, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Services.

Termination

We may suspend or terminate your access to the Services at any time, with or without cause, and with or without notice. Upon termination, your right to use the Services will immediately cease.

Dispute Resolution

Any dispute arising from these Terms or the Services that cannot be resolved informally shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You and Chamoy Labs, LLC agree to waive the right to a trial by jury or to participate in a class action.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

Changes to These Terms

We may update these Terms from time to time. Any changes will be reflected by updating the “Last Updated” date at the top of this page. Your continued use of the Services after any changes indicates acceptance of the updated Terms.
